Terms of Service
Effective 17 August 2026. Covers the Varta platform, this website, and the Varta Android app.
These terms are an agreement between you and Shivankit Technologies(“Varta”, “we”). Using the platform, the website, or the app means you accept them. If you don't, don't use the service.
1. This is a beta
Varta is in closed beta. Things will break, features will change, and occasionally a call will not go the way you hoped. Do not put Varta in the path of anything where a failed or wrong call causes real harm — medical, legal, financial or safety-critical situations included.
Beta access is free within a fair-use cap of roughly 500 minutes per month. We may change or withdraw beta access, but we'll give notice by email before we do anything that affects a working setup.
2. Your account
- You must be 18 or older.
- Give accurate information when you sign up, and keep your credentials to yourself. Anything done through your account is your responsibility.
- One person or organisation per account. Don't resell access or share credentials with people whose actions you can't answer for.
- Tell us promptly at common@shivankit.com if you think your account has been compromised.
3. What you may not do with it
Varta places and answers real phone calls. Misuse doesn't just break our terms, it puts our telephony providers in breach of theirs. So, specifically, you may not use Varta to:
- Make unsolicited bulk or automated marketing calls, or anything that would breach TRAI regulations, the Do Not Disturb registry, or equivalent rules where you operate.
- Impersonate another person or organisation, or configure an agent to deny being an AI when asked directly.
- Defraud, phish, harass, threaten, or extract credentials, OTPs or payment details from the person on the other end.
- Remove, suppress, or work around the AI and recording disclosure that plays at the start of every call.
- Record anyone where doing so is unlawful in their jurisdiction, or where you have not obtained the consent your sector requires.
- Break the service on purpose: probe or overload the infrastructure, reverse-engineer it, or circumvent usage limits.
- Break any applicable law, which is the general case of all of the above.
We can suspend an account immediately when we have good reason to think this section is being violated. Where it's safe and lawful to do so, we'll tell you why and give you a chance to fix it.
4. Your responsibilities as the caller
When your agent talks to someone, you are the Data Fiduciary for that conversation and we are your processor. That means the consent, the notice, and any sector-specific obligations are yours. We provide the disclosure at pickup and the tooling; we do not and cannot judge whether your particular use is lawful in your context.
5. Content and ownership
- Yours stays yours. Your recordings, transcripts, contacts, agent prompts and cloned voices belong to you. We hold them only to run the service for you.
- Ours stays ours. The platform, the app, and everything we built to make them work remain our property. These terms grant you a limited, non-exclusive, non-transferable right to use the service, nothing more.
- Voice cloning.Clone your own voice, or one you have explicit written permission to use. Cloning someone else's is grounds for immediate termination, and is your liability, not ours.
6. The Android app
The app is licensed, not sold. It requires a Varta account to do anything useful. It registers with Android's telecom stack so agent calls behave like calls, and it asks for the microphone to carry them — both explained in the Privacy Policy.
The Play Store build updates only through Google Play. The self-updating build is a separate direct-distribution channel and is not what you get from the store.
7. Third-party services
Varta depends on carriers, speech and language model providers, and cloud infrastructure, listed in the Privacy Policy. Their outages become our outages. We choose them carefully and we're responsible to you for the service overall, but we don't control their networks.
8. Availability
There is no uptime guarantee during the beta. We do not promise the service will be uninterrupted, that transcription will be accurate, or that an agent will always say the right thing. Language models get things wrong; review anything that matters.
9. Liability
To the maximum extent Indian law allows, the service is provided “as is” and we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost business, or lost data. Our total liability for any claim is capped at the greater of the amount you paid us in the twelve months before the claim, or ₹5,000 — which, during a free beta, will usually be the latter.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
10. Indemnity
If someone brings a claim against us because of how you used Varta — a call you had it make, consent you didn't obtain, a voice you shouldn't have cloned — you agree to cover the resulting costs and damages.
11. Ending it
You can stop whenever you like: use the deletion form and your account and data go. We may suspend or terminate an account for a breach of these terms, a legal requirement, or if we discontinue the service — with reasonable notice except where a breach makes that unwise.
On termination your right to use the service ends immediately. Data deletion follows the schedule in the Privacy Policy.
12. Changes to these terms
We'll email registered users before any material change takes effect and update the date at the top. Continuing to use Varta afterwards means you accept the revised terms.
13. Governing law
These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them.
